ASIC has made clear that AI implementations must comply with the fundamental obligation to provide services "efficiently, honestly and fairly." This isn't just about algorithmic fairness it's about being able to explain and justify AI-driven decisions that affect consumers.

APRA has given regulated entities a "green light" to accelerate AI adoption, but this comes with implicit expectations around robust risk management that many organisations appear unprepared for.

Through our extensive work with leading organisations across Financial Services, Superannuation, and Insurance sectors, we have identified five critical challenges that consistently hinder effective AI governance implementation:

  • AI-Augmented Asset Visibility: Organisations lack clear visibility into how much AI is being used across their development processes. The widespread use of AI-generated code, requirements, and test cases creates a blind spot where enterprises cannot confidently measure their AI usage or establish proper oversight.
  • Audit Framework Gaps: Existing audit frameworks have significant shortcomings when applied to AI-enhanced processes. These established methods were designed for predictable systems and cannot adequately address the unique accountability, traceability, and validation requirements that AI-driven operations demand.
  • Risk Assessment Limitations: Traditional risk assessment methods are inadequate for AI systems that can behave unpredictably and develop unexpected capabilities. Conventional risk models struggle to properly assess and categorise risks from systems that can evolve beyond their original design.
  • Regulatory Compliance and Transparency: Ensuring AI decision-making meets regulatory transparency standards remains challenging. Organisations must develop ways to explain complex AI outputs in clear terms for both customers and regulators, whilst maintaining the accuracy of the underlying decision processes.
  • Cross-Functional Coordination Challenges: Effective AI governance requires smooth collaboration between traditionally separate teams—technology, risk, legal, and business operations. Each area has different priorities, risk appetites, and technical languages, creating coordination difficulties that need structured governance frameworks and clear accountability.

Sector-Specific Considerations

While core governance principles apply across regulated industries, each sector faces unique challenges:

Financial Services: Must balance innovation with consumer protection, ensuring AI doesn't perpetuate bias in lending, insurance, or investment decisions. ASIC's focus on the "efficient, honest, and fair" standard means every AI use case must demonstrate consumer benefit.

Superannuation: With $2.7 trillion in assets under management and complex fiduciary obligations, super funds face particular challenges around long-term member outcomes and investment strategy AI integration. The trustee duty framework adds additional complexity to AI governance requirements.

Insurance: AI governance must address underwriting fairness, claims processing transparency, and pricing model accountability. The potential for AI to create or amplify discrimination requires particular attention to bias testing and mitigation.

Enterprise cost of inaction

The window for proactive AI governance is closing rapidly. Organisations that continue to deploy AI without adequate oversight face escalating risks:

  • Regulatory Scrutiny: ASIC and APRA are increasing their focus on AI governance, with enforcement actions likely for organisations that can't demonstrate adequate controls.
  • Operational Risk: Ungoverned AI systems can create unexpected operational failures, customer harm, and reputational damage.
  • Competitive Disadvantage: Organisations with robust governance can deploy AI more confidently and at greater scale.
  • Remediation Costs: Retrofitting governance to existing AI implementations is significantly more expensive than building it in from the start.

Moving Forward

AI governance in regulated industries isn't optional, it's a business imperative. The Australian regulatory approach provides flexibility for organisations to implement frameworks suited to their risk profile and business model, but this flexibility comes with the responsibility to demonstrate compliance with fundamental consumer protection obligations.

Successful AI governance requires more than technology solutions. It demands cultural change, cross-functional collaboration, and ongoing commitment to balancing innovation with risk management. Organisations that embrace this challenge proactively will have significant competitive advantages in the AI-powered economy.
